Overview

This Feedback Digest has been updated to include nineteen feedbacks from UK and international commercial mediations since November 2013. All feedbacks think highly of Dr Al Jarratt for his calm, persuasive way of dealing with the parties to identify the core issues in dispute with minimal time and effort. They consistently point to his meticulous prior preparation for the mediation and eleven parties cite this as helping save time at the mediation and leading to a satisfactory settlement. Dr Jarratt’s exceptional way of communicating with the parties and winning over their trust was key to probe deeper, identify the main points in dispute, narrow the differences between the parties and present creative settlement options. Dr Jarratt came over as being very trustworthy to the extent that the parties were willing to treat him as a member of their team confiding in him the limits of their willingness to settle their dispute. This signifies his impartiality and independence. One party referred to Dr Jarratt as a magician targeting key issues and proposing solutions for intractable problems in difficult circumstances. Another referee described Dr Jarratt as being a superb mediator steering the parties in the right direction and producing the perfect outcome in a quick, cost effective and stressless way. This led to the preservation of continuing business relationships between the three disputant companies. Feedback also confirmed Dr Jarratt’s ability to pick up seemingly irrelevant items in the parties’ submissions that eventually proved to hold the key to solve the entire dispute. Some parties stated that they had not taken part in mediation before and were not familiar with the process but felt at ease due to Dr Jarratt’s fitting approach for the conduct of the mediation. All the disputes in the feedbacks settled and all parties said they would use this mediator again giving him a rating of 5/5 on the IMI Feedback Request Form, as they did for his skill and ability, 5/5. Dr Jarratt also received 5/5 for the costs of the mediator except one (4/5), and 5/5 for satisfaction with the mediation process except two (4/5). No reportable negative comments have arisen.

Dr Jarratt is a highly experienced commercial mediator, arbitrator, expert determiner, adjudicator and expert witness in the UK and internationally. He has over thirty years’ experience in these specialisms, sixteen accreditations and has written published work, given numerous talks and led workshops on dispute resolution. He is a Chartered Engineer, Chartered Manager, Fellow of five professional institutions including the CIArb and a Member of two others.

He is on the major UK mediation panels such as the Barrister Group and many internationally such as the International Mediation Institute as a Certified Mediator and an Accredited Mentor. He has arbitrated and mediated over 1140 UK and international disputes since 1993 with a mediation success rate of 93%.

Dr Jarratt has mediated and arbitrated civil and structural engineering, architectural, quantum, MEP and other construction disputes including Final Accounts, interim monthly applications for payment, variations, retention money, contra charges and delay and disruption. Family disputes include custody and care of children, maintenance payments and arrangement, welfare, education, financial responsibilities and asset sharing, inheritance and care of the elderly. Other disputes include, intellectual property, wine production, agriculture, health, maritime, insurance, retail, finance, personal injury, employment, inheritance, estate management, misrepresentation, professional negligence, transport, pharmaceuticals, manufacturing, telecommunications, IT and renewable energy.

Dr Jarratt’s arbitration appointments include sole arbitrator, tribunal member and presiding arbitrator. Arbitral seats include London and Dubai under their applicable governing laws. He has also advised project financiers, clients, employers, consultants, contractors, subcontractors, suppliers and other stakeholders under the NEC forms of contract, FIDIC’s Red, Silver and Yellow books and various JCT and other types of contract.

He regularly invites LLM students, university lecturers and legal professionals to join his arbitration hearings and mediations as observers and supports them throughout the process. He has written papers on mediation. He is a past member of the Editorial Advisory Panel of Management, Procurement & Law journal and also on the CMI eastern board and a past chairman of the CIArb East Anglia branch. He has also refereed and reviewed books on arbitration and FIDIC and other forms of contract. Dr Jarratt is a Professional Reviewer, Professional Assessor, Peer Interviewer, Tutor, Examiner and Moderator for four professional institutions.

He regularly chairs and speaks at professional events and is a past speaker for the IStructE and the ICE and a regular one for the CIArb. He has run the mediation workshops at a past ICE’s flagship Annual ADR Day. He was also a speaker on mediation as early as 1994 at the IStructE during their 75th anniversary celebrations alongside its President and two Past Presidents.
